measures for infringements of library regulations

based on article 12 in chapter 2 of the regulations of beijing libraries and the fees list of the capital library of china, the compensations from the reader are listed as follows for the supervision of the reader’s service.

1 overdue fees

1.1 the overdue fess for the “all-purpose card” begins from the natural day of the overdue date. fines are 0.2 yuan per day for each book and the maximum amount is 30 yuan per book.

1.2 the overdue fess for the children’s reader’s card begins from the natural day of the overdue date. fines are 0.1 yuan per day for each book and the maximum amount is 20 yuan per book.

2 damages

2.1 any marked, smeared or damaged places on the general literature will be fined ranging from 2 to 10 yuan according to the following standards:

1) for any marked, smeared or damaged places ranging from 1to 5 pages and less than 30% of the whole literature, 2 yuan will be fined.

2) for any marked, smeared or damaged places ranging from 6 to 20 pages and less than 30% of the whole literature, 5 yuan will be fined.

3) for any marked, smeared or damaged places ranging from 21 to 40 pages and less than 30% of the whole literature, 10 yuan will be fined.

4) for any marked, smeared or damaged places more than 41 pages or more than 30% of the whole literature, the original price of the book will be fined and the reader is not allowed to take back the book.

2.2 any marked, smeared or damaged places on other literature will be fined according to the following standards:

1)for the literature in stock, any marked, smeared or damaged places ranging from 1 to 40 pages and less than 30% of the whole literature, the reader should pay for three times of the fines for the damages of the general literature; any marked, smeared or damaged places more than 41 pages or more than 30% of the whole literature, the original price of the book will be fined and the reader is not allowed to take back the book.

2) for any marked, smeared or damaged places on the literature produced in the minguo period, precious literature and special literature, the fines will be determined by the precious degree of the literature.

3) for any marked, smeared or damaged places on the general literature or the rare ancient books, the reader compensate for it according to the cultural relics protection law of the people’s republic of china.

2.3 if an item from the in stock literature is cut or ripped, the reader should compensate for it according to the compensation measures for lost literature.

2.4 if an item is damaged by an animal, regardless of the damage degree, the reader should compensate for an identical book or pay for the original price of the book, and the reader is no longer entitled to borrow the book.

3 loss

3.1 the reader should claim the loss and look for the lost item. the reader should compensate for an identical book with 5 yuan processing fees.

3.2 from the returning date, the reader should purchase the book for compensation. if no identical book can be found within the time limit, the reader should compensate for the book according to the following standards with 5 yuan processing fees:

1) general domestic publications: documents published from 1949 to 1975 are compensated at 2 multiplies the original price multiplies the number of years since they were published; documents published in 1976-1990 are compensated at original price multiplies the number of years since they were published; documents published from 1991 to 1995 are compensated at 10 times of the original price; documents published from 1996 to 2000 are compensated at 5 times of the original price; documents published after 2001 are compensated at 2-3 times of the original price; documents published in the past 3 years are compensated at 2 times of the original price.

2) imported foreign publications are compensated at 5 times of the original price.

3) specific literature such as maps, microfilms, booklets and photos are compensated at 20 times of the original price.

4) documents produced in the minguo period or with special value are compensated according to the market value of the item.

5) ancient books refer to those published before and include 1911, the compensation should be done according to the market value of the item.

6) compensation for non-priced reading materials refers to the prices of similar items.

3.3 if one or more volumes are lost from a series of books, the reader must compensate for the price of the entire series and is not allowed to take back the other volumes.

3.4 if the original item is found after compensation has been paid, he/she can ask for a refund of the compensated amount upon presenting the original receipt. however he/she must pay for the overdue fee from the day compensation was paid to the day the original item was returned.

3.5 the loss of the literature in stock should be compensated at 2 times of the prices of the general literature.

4 theft

4.1 if any library item is concealed by a person, in the bag or in other items without being checked-out, once discovered, it will be regarded as theft. if the item is not chased back, the reader must pay for a fine of 20 to 50 times of the original price of the item

4.2 if one or more volumes are stolen from a series of books, the reader must compensate for the price of the entire series and is not allowed to take back the other volumes.

4.3 if the original price of the stolen item is more than 300 yuan, the case can be forwarded to the police.

5 other related regulations

5.1 for any of the above infringements of the regulation, if the reader is reluctant to pay for the overdue fees, the compensation and so on, the library can halt or cancel the reader’s card (the deposit will be used as the compensation).

5.2 for any reader with severe infringement and a bad attitude, the library can halt or cancel the reader’s card until the issue is settled through legal means.
